Welcome to Lanka Tradies. These Terms of Service ("Terms") govern your use of our platform that connects Sri Lankan tradespeople with customers across Australia. By accessing or using Lanka Tradies, you agree to be bound by these Terms.

Please read these Terms carefully before using our platform. If you do not agree with these Terms, you must not use Lanka Tradies.

1Acceptance of Terms

By creating an account, accessing, or using Lanka Tradies, you confirm that:

  • You are at least 18 years of age
  • You have the legal capacity to enter into a binding agreement
  • You agree to comply with these Terms and all applicable laws
  • If registering as a tradie, you have the necessary licenses and qualifications to perform the services you offer

2User Accounts

Account Registration

You must provide accurate, current, and complete information during registration and keep your account information updated. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.

Account Security

You must immediately notify us of any unauthorised use of your account or any other security breach. We are not liable for any loss arising from unauthorised use of your account.

One Account Per Person

You may only create and maintain one account. Creating multiple accounts may result in termination of all accounts.

3Tradie Requirements

If you register as a tradie on Lanka Tradies, you represent and warrant that:

Licenses and Qualifications

  • You hold all necessary licenses, permits, and certifications required for your trade in your operating state/territory
  • Your licenses and certifications are current and valid
  • You will maintain these qualifications throughout your use of the platform

Insurance

  • You maintain appropriate public liability insurance for your trade
  • You maintain any other insurance required by law or industry standards
  • You will provide proof of insurance upon request

ABN and Business Compliance

  • You have a valid Australian Business Number (ABN)
  • The ABN you provide is accurate and registered to you or your business
  • You comply with all applicable tax and business registration requirements

Accurate Information

  • All information in your profile is true and accurate
  • Your skills, experience, and qualifications are accurately represented
  • You will update your profile promptly if any information changes

4Customer Responsibilities

As a customer using Lanka Tradies, you agree to:

  • Provide accurate and complete information about your job requirements
  • Communicate honestly and respectfully with tradies
  • Make timely decisions about hiring and project requirements
  • Pay tradies fairly and promptly for completed work (payments are made directly between you and the tradie)
  • Provide safe and reasonable working conditions
  • Obtain any necessary permits or approvals for work on your property
  • Leave honest and fair reviews based on your genuine experience

5Platform Role

Lanka Tradies is a platform that facilitates connections between customers and tradies. We are not a party to any agreement between you and any tradie or customer.

We do not:

  • Employ any tradies listed on our platform
  • Guarantee the quality, safety, or legality of any services
  • Guarantee the accuracy of any user's information or qualifications
  • Handle payments between customers and tradies
  • Provide warranties for any work performed
  • Mediate disputes between customers and tradies (though we may assist where possible)

All agreements for services are made directly between the customer and the tradie. You are responsible for verifying a tradie's credentials, insurance, and suitability for your project before engaging their services.

6Prohibited Conduct

You agree not to:

  • Provide false, misleading, or inaccurate information
  • Impersonate any person or entity
  • Harass, abuse, or threaten other users
  • Post discriminatory, offensive, or inappropriate content
  • Use the platform for any illegal purposes
  • Attempt to circumvent the platform to avoid fees or policies
  • Spam or send unsolicited communications
  • Collect or harvest user data without consent
  • Interfere with the platform's operation or security
  • Post fake reviews or manipulate ratings
  • Use the platform to promote unrelated services or products
  • Violate any applicable laws or regulations

7Reviews and Content

User Reviews

Reviews must be honest, fair, and based on genuine experiences. You may only review tradies whose services you have actually used. We reserve the right to remove reviews that violate these Terms or our community guidelines.

Content Ownership

You retain ownership of content you post on Lanka Tradies. By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with operating and promoting the platform.

Content Moderation

We may, but are not obligated to, monitor, review, or remove user content at our discretion. We are not responsible for any user-generated content on the platform.

8Intellectual Property

The Lanka Tradies platform, including its design, features, content, logos, and trademarks, is owned by us or our licensors and is protected by Australian and international intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our platform or its content without our express written permission.

9Limitation of Liability

To the maximum extent permitted by Australian law, Lanka Tradies, its owners, operators, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform.

This includes, but is not limited to, liability for:

  • The quality, safety, or legality of services provided by tradies
  • The conduct of any user, whether online or offline
  • Any damages arising from transactions between users
  • Loss of data, profits, or business opportunities
  • Service interruptions or technical issues

Nothing in these Terms excludes or limits liability that cannot be excluded under Australian Consumer Law, including liability for death or personal injury caused by negligence.

10Indemnification

You agree to indemnify, defend, and hold harmless Lanka Tradies and its owners, operators, employees, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from:

  • Your use of the platform
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Any services you provide or receive through the platform

11Dispute Resolution

Between Users

Disputes between customers and tradies should be resolved directly between the parties. While we may provide assistance or information where possible, we are not obligated to mediate or resolve disputes between users.

With Lanka Tradies

If you have a dispute with Lanka Tradies, we encourage you to contact us first at admin@lankatradies.com.au to attempt to resolve the matter informally. If we cannot resolve the dispute, it will be subject to the jurisdiction provisions below.

12Termination

By You

You may terminate your account at any time by contacting us or using the account deletion feature (if available). Upon termination, your right to use the platform will cease immediately.

By Us

We may suspend or terminate your account at any time, with or without cause and with or without notice, including if we believe you have violated these Terms. Reasons for termination may include:

  • Violation of these Terms or our policies
  • Fraudulent or illegal activity
  • Conduct harmful to other users or the platform
  • Extended periods of inactivity
  • Upon request from law enforcement

13Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on our platform and updating the "Last updated" date. Your continued use of Lanka Tradies after changes are posted constitutes your acceptance of the modified Terms. If you do not agree with the changes, you must stop using the platform.

14Governing Law and Jurisdiction

These Terms are governed by the laws of Australia. Any disputes arising from or relating to these Terms or your use of Lanka Tradies shall be subject to the exclusive jurisdiction of the courts of Australia.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
